(1) These General Terms and Conditions apply to all orders you place in our online shop africadrinks.
(2) Your contractual partner is: D. Tagoe Imports, owner David Nii Ayi Tagoe, Konradinstraße 5, 12105 Berlin, Germany, phone +49 30 8911602, email info@africadrinks.de.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB).
(4) We do not accept deviating terms of the customer unless we expressly agree to them.
§ 2 Conclusion of the contract
(1) The presentation of products in the online shop is not a legally binding offer but a non-binding invitation to order.
(2) You can add products to the cart, enter your details in the checkout and choose a payment method. Before submitting the order you see all details in an overview and can correct input errors using your browser's back function or the links in the checkout. By clicking the order button you submit a binding offer to buy the goods in the cart.
(3) We confirm receipt of your order by email without delay. This confirmation of receipt is not yet an acceptance of your offer. The contract is concluded when we accept your order by an order confirmation email or by shipping the goods.
(4) When paying with PayPal, in deviation from paragraph 3 the contract is concluded as soon as you confirm the payment at PayPal.
(5) The contract language is German; this English version is provided for convenience. We store the contract text and send you the order details by email. You can view and print these terms at any time on this page.
§ 3 Protection of minors
(1) We sell alcoholic beverages such as beer only to persons aged 16 or over (Section 9 German Youth Protection Act, JuSchG). By placing your order you confirm that you have reached this minimum age.
(2) The carrier hands over parcels containing alcoholic beverages only to the recipient in person after checking identity and age against an official ID. If the recipient is not available or cannot prove the minimum age, the parcel will not be handed over. Delivery to parcel lockers (Packstation) is not possible for these parcels.
§ 4 Prices, shipping costs and deposit
(1) All prices are final prices and include statutory VAT.
(2) Shipping costs are added. You can find the amount in the shipping information and in the checkout.
(3) For returnable bottles we charge a deposit of €0.08 per bottle. The deposit is shown separately on the product and in the cart. How to get your deposit back is explained under Deposit and bottle return.
§ 5 Delivery
(1) We only deliver to addresses in Germany.
(2) The delivery time is shown on each product and in the shipping information. For payment in advance, the delivery period starts on the day after your payment instruction.
§ 6 Payment
(1) You can pay in advance by bank transfer or with PayPal.
(2) Payment in advance: you receive our bank details with the order confirmation. Please transfer the amount within 7 days. We ship the goods after receipt of payment.
(3) PayPal: you are redirected to PayPal during checkout. There, depending on what PayPal offers, you can also pay by credit card, Apple Pay or Google Pay. PayPal's terms of use apply.
§ 7 Retention of title
The goods remain our property until paid in full.
§ 8 Transport damage
If goods are delivered with obvious transport damage, please report it to the carrier immediately if possible and inform us. This does not affect your statutory rights; the report helps us assert our claims against the carrier.
§ 9 Warranty
The statutory warranty rights apply.
§ 10 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act.
(2) In case of a slightly negligent breach of an essential contractual obligation, whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely, our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 11 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the withdrawal policy. You can also withdraw from the contract online using the Withdraw from contract function.
§ 12 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.
